2. Purpose and description of the services

These Terms of Service (the “Terms”) apply to the services Ektaya offers to individuals (consumers): Reiki energy sessions, held entirely at a distance.

These sessions are a wellbeing and relaxation practice. They are in no way a medical act, a diagnosis or a treatment, and they are not a substitute for medical follow-up or medical advice. You are encouraged to continue any treatment you are already receiving and to see a healthcare professional for any question about your health.

3. Price: pay what you want

Sessions are offered on a pay-what-you-want basis: there is no fixed price. You choose the amount you pay, after the session. The payment link lets you enter the amount of your choice. As a purely indicative example, some people pay $20, others more than $100.

Your contribution is payment for the session you received. It is not a donation and does not entitle you to any tax deduction.

Ektaya LLC is a company established outside the European Union. Contributions are paid in US dollars; your bank may convert the amount into your own currency.

Gift session: a session can be given as a gift to another person. The person giving the gift chooses the amount of their contribution and pays it in advance. The person receiving the gift has nothing to pay for this session. They request their session within 12 months after the payment.

4. Requesting a session and payment

You can request a session through the form on the Book a session page of the site, or by email at contact@ektaya.com. Ektaya replies personally and agrees with you on the date and time of the session. Ektaya remains free not to follow up on a request, in particular when the session does not seem suited to the situation described.

For a session for yourself, no payment is asked in advance. After the session, Ektaya sends you a secure payment link (through the Stripe platform), where you enter the amount of your contribution. An invoice is sent to you by email after payment.

5. Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, you have in principle 14 days from the date the contract is concluded to exercise your right of withdrawal, without having to give a reason.

For a session for yourself, since no payment is requested before the session, you can cancel your session at any time before it takes place, at no cost and without giving a reason, by simply emailing contact@ektaya.com.

For a gift session, the person giving the gift can ask for their contribution to be refunded by emailing contact@ektaya.com within 14 days after their payment, as long as the session has not taken place.

Exception (service performed before the end of the period): when a service is fully performed before the end of the withdrawal period, you lose your right of withdrawal if you expressly asked for the service to be performed before the end of that period and acknowledged that you will lose your right of withdrawal once the contract has been fully performed (Article L.221-28 of the French Consumer Code). By agreeing with Ektaya on a session date earlier than the end of the 14-day period, you expressly request this performance and acknowledge that you lose your right of withdrawal once the session has taken place.

6. Rescheduling and unavailability

Rescheduling by you: you can move your session at no cost by letting Ektaya know as early as possible by email at contact@ektaya.com. A new date is then agreed according to availability.

If Ektaya is unavailable: if Ektaya has to cancel a session for its own reasons, it informs you as soon as possible and offers you a new date. For a gift session, if no rescheduling is possible, the contribution already paid is refunded to the person who paid it.

7. Obligations and limits

The Reiki energy sessions offered are a wellbeing and relaxation practice. They are not a medical act, they make no diagnosis, and they in no way replace medical advice, a medical consultation or a medical treatment.

Ektaya commits to providing its services with care and with respect for the client. You remain responsible for your own health and agree not to stop any medical treatment you are receiving on the basis of the sessions alone. Ektaya cannot be held responsible for results, which vary from person to person.

8. Complaints and dispute resolution

Any complaint can be sent by email to contact@ektaya.com. Ektaya commits to replying within a reasonable time, and at the latest within 30 days.

Amicable resolution: in the event of a dispute, you and Ektaya will try to find a solution together by email at contact@ektaya.com before taking any action.

A consumer residing in the European Union keeps all the rights granted by the law of their country of residence and may, where appropriate, contact the European Consumer Centre of their country.

9. Personal data

The data collected when you request a session, and during sessions, is handled in accordance with our Privacy Policy.

10. Governing law and jurisdiction

A consumer residing in France or elsewhere in the European Union benefits from the mandatory consumer protection rules of their country of residence, which nothing in these Terms can take away (Regulation (EC) No 593/2008, known as “Rome I”, Article 6).

For everything else, these Terms are governed by the law of the State of Wyoming (USA). In the event of a dispute, and if it cannot be resolved amicably, jurisdiction is exercised subject to the protective rules that apply to consumers.
